30-Sep-2024 (In Divorce Law)
Police removed my sister mother and tauji name from Chargesheet in 498a case. Court only framed charges on me. I want to know what should I do so that their names can never come up in this case ever and their fir records are wipes off?
DEAR SIR
ITS GOOD THATNTHAT POLICE HAS REMOVED THE NAME OF YOUR FAMILY MEMBERS FROM CHARGESHEET.
BUT THE RIGHT OF COMPLAIANAT IS STILL OPEN TO MOVE AN APPLICATION FOR REINVESTIGATION. IT IS BETTER TO KEEP SILENT AND MOVE STRATEGICALLY IN YOUR CASE WITH CONSULT OF YOUR LAWYER.
THIS WILL HÉLP TO ACHEIVE YOUR OBJECTIVE
If your sister's and mother's names have been removed from the FIR, there are certain circumstances under which their names could be added again:
If the police or the court finds new evidence indicating that your sister and mother were involved in the crime, their names can be included again.
If new information arises during the investigation, or if the investigation is reopened, their names could be re-added.
