14-Mar-2023 (In Divorce Law)
My wife left me one year back and she filed section 9 case now. I got court notice to attend hearing on particular date but it doesn't have points. Can I see what points she mentioned in the case online?nHow to handle this false case on me? I am not interested. She openly said in-front of family members that not interested. She claiming that sexual harassment, but reality is separating me from day 1 of marriage, after parents counselling we had sex for few times with my interest only. She is at her home from day 1. After 3 months she spent 1week in a month till next 3 months. After that she went for job purpose and not returned backFrom last one and half year she is not coming back, not coming for mutual divorce. So I filed section 13 1(a) on her. Please suggest how to handle these cases.

Dear client Section 9 under HMA which is a petition that a spouse files for restitution of conjugal rights, in case there are no other cases filed / pending before any court of law, you need to reply to that petition. In case you have only received a court notice and not the complete copy of the petition, you can on the date of hearing (which would be mentioned in the notice) appear on your own/hire a lawyer and request a copy of the same for you to prepare accordingly. feel free to get in touch for any further discussions.

The section 9 case filed by the wife can be challenged on the ground that it is the wife who has left the husband for more than one year and has not given him all the happiness of being the husband of a wife among many things. Section 13A can be handled and contested with due care and be allowed by the court.

If your wife has filed any baseless petition then it needs to get dismissed by the court. Prove her cruelty and conduct so that court dismisses her case. Also If you have already filed divorce, then kindly take advice from your current lawyer as he must have strategise your case. Taking any action in other cases might go contrary to your divorce case, so it’s better to be careful. However if you wish to have a second opinion then please share the petition so that better advice can be advanced to you. Feel free to contact Thanks

As per your words, your wife had filed a case of Sec 9 and in counter you have filed a case of 13 1(a) for divorce. You need to show in court the malafide intention of your wife with you and your family members
