My wife left me. Filed sec 9 on me. she stated in document that I am harassing her for money. Her allegation was I am watching porn videos in night and asking different angles while fucking her.n100% false. How to counter it. Next week counselling in mediation center. I filed for sec 13 1 ia because she is lying and doing emotional cheating from day1 of our marriage.
it is court referred mediation, not counselling. As part of their duty, mediators should first explain their duty, powers and limitations. They are required to send a report to court after completion of mediation process only if the partics agree on every matter. Otherwise, they send only a failure report. So, what they note down will not be considered.

Dear Sir,
Be inform that the notes prepared by counselor will not be placed before the Judge. Such conciliations are arranged to know whether the parties are ready for mutual divorce etc. You cannot get any benefit out of it. Just fight for Section 9 application filed by your wife.

The primary work of the counsellor is to listen to the dispute amongst parties that may be about property, child, maintenance, cruelty, adultery, frequent fights, etc and accordingly a report is prepared after noting down relevant points from both parties.
The judge definitely considers the report of the counsellor but does not rely on it for its final order in the case.

You need to write down all your grievances in your WS against the petition filed by your wife under section 9 alleging that all the facts put by your wife are false and imaginary. And if you don't want to meditate then cancel the mediation and send the file back to the court. you can counter this by taking the defence that all allegations made by your wife have to be denied. also you had filed divorce under section 13 1 of Hindu marriage act that just to for the sake of defence your wife had filed section 9 petition against you

Well, you can seek Unilateral Divorce from her, however, you have to convince the court, that, she has illegally deserted you by putting fake allegations on you, for which, she holds no evidence or weak evidence. Once Court gets convinced with this argument and she doesn't produces any concrete evidence against you to legitimise that her deserting you was legal, then, you will get a Divorce Decree in your favor, despite her refusal from granting you a Divorce Decree.
