My wife left 2 years ago. She put sec9. I filed Sec13 1ia. Failed counselling at mediation center. I want divorce because she was doing emotional cheating. She intentionally filed 125crpc. Next hearing on Nov. She was working in MNC company earlier, now she was not working, she mentioned that health issues. How to counter maintenance case? I do not want to give money.

Dear Sir, You must produce all the previous records of your wife working in MNC company as such you can establish that she unnecessary left the job. In the meanwhile go for evidence in your Divorce case and complete the same.

Dear Client, If both are working the court may decide lesser amount of maintenance you should try to settle via mediation and there try to resolve that problem amicably with the consent of mediators .

Unlike earlier, maintenance cannot be claimed by a wife from her husband on false grounds. She has to file a detailed affidavit of assets and liabilities and if she makes any false statement or suppresses information then she can be published for cheating the court. The husband has to fight for it.

firstly, one needs to file an Objection in that maintenance matter. In that Objection we had mention about her education qualifications as well as salary slip if you are able to provide. secondly, try to focus on earnings showing on records that you have earn way lesser than she earns and you don't have that many assets.
