My In-laws have sent me divorce summon through court

09-Jul-2023 (In Divorce Law)
I've received summon from court by my husband's side family.... Summon says I have to present in court as on given date but I'll be out of station that day and won't be able to go to court.... Should I just ignore the summon as it the first summon aur should I hire a lawyer to represent myself.... I don't want to hire a lawyer now so my question is can i just skip the date..?? Will court send me another summon?

As you told that your husband has sued you and you have received his goods, but on the date given by the court, you are out of the house and cannot reach the court on that date, then in such a situation you can Court will not make any adverbs order against you on the basis of first summons

its depend upon summons if you share the copy of summons then all the things are clear . But of the summons only about your presentation of party then you can ignore it for couple of hearings it is better to you to appoint an advocate for case proceedings.

if you have recieved a summon than you must not ignore it because “failure to appear” means in court that a criminal charge has been made against you for not showing up. Failure to appear is a crime that can lead to criminal penalties. There are many possible consequences for failure to appear. The consequences will depend on the facts of your specific situation. In some cases, you may be required to just pay a small fine. In other cases, a judge may issue an arrest warrant in which you will be held until a new court date has been set,If a summons issued from a court is deliberately ignored, or the person summoned refuses to comply with the same, in the Indian context it is an offence under section 174 of the IPC,against authority of the court and punishable with simple imprisonment for a term which may extend to six months, or with fine which may extend to one thousand rupees, or with both.

if you received the summon from the court then court will not issue further summon to you for next date. if you not appear in the court on date fixed then court may proceed the case exparty against you. it is better to appoint any lawyer who can represent you and get another date for filing the written statement. if you need any further information or clarification then please contact me without any hesitation through the administrator of this website
