My husband filed divorce sec13 1 i(a) i(b) staying together and leading normal married life. Forcing for to get pregnant 3rd time. Force sex every night.History of domestic violence and abuse since 10 years.Complaint twice with police but he compromised. Asked last chance.after that he filed divorce he is hiding the summons till 25th June 23.n26th June he physically abused me and accused me of stealing.i called 112 when he chocked me.no FIR yet.what are options with police and other cases.

Dear Client, You may file an appeal against order if passed by Family Court in divorce proceedings, and as per the violence part ,approach authorities to file cases against them under section 498-A and other related section, 125 Cr.P.C. and Section 12 of the DV Act.

there are police station especially for cases such as yours kindly report your issue there and if there's no f.i.r or complaint filed, you can file an application directly to a magistrate u/s 156(3) through a advocate that you will appoint. kindly let me know if I could be of any more assistance to you .thank you

As you told, your husband has filed a case against you in the court for divorce and he abuses and domestic violence with you everyday and on 25 June 2023 also he had assaulted you because of which you had called the police helpline 112, but till date the policemen did not help youAny F.I.R.is not writtenIf the police is favoring your husband and not listening to you, then in such a situation, you can file an application under Section 156 3 CrPC to file a case against your husband

don't worry about stealing FIR because police never lodge fir against the wife of stealing police knows very well that husband file false complaint.
The second thing about the divorce case it is neccessory for you to present in that divorce case.

since there is a trace of barbarity committed by your man upon you more particularly domestic violence has been committed even two triangulate as well as choke this also comes within the perview of assault under section 351 of the Indian Penal Code. it would not be appropriate for me since the matter is extremely sensitive to tell you exactly what needs to be done here for precision you may seek my consultation and I'm sure I will be able to give you some sort of remedy
