My husband denied settlement as I am educated and entrepreneur
12-Oct-2023 (In Divorce Law)
My husband applied for divorce after 2 years of marriage stating that the marriage is non consummated. But it's not true and I have also tried artificial means for child birth, due to male factor deficiency in him. No child so far. I have medical reports for all these. Moreover i got him a personal loan of 30 lakhs for him and paid the emi every month for one year. He repaid the loan but not the emi to me. I have bank records for this too.
He is not giving the jewels given by him on the day of marriage too. My parents have taken care of all the expenses related to this marriage.
He is now forcing me to sign for mutual consent. He denied settlement stating that I am educated and I am running small start-up. I am still dependent on my parents for my expenses as start-up company will take years to bring profits.
Can I contest my husband's divorce application and recover our expenses for marriage, loan and medical expenses? Am I eligible for settlement?
first of all you can file a misc suit sec 24 of hindu marriage act and demand for daily expenses and advocate expenses also. after that you file a maintenance suit in the same court and demand interim relief first. whether court decide you maintenance suit you still fight your divorce petition.
