Hello, I understand your concern regarding the interference of another woman in your married life. However, before suggesting any legal action, it is important to examine the complete facts and available evidence. Merely having a relationship or friendship with a married person may not, by itself, constitute a criminal offence. Legal remedies may be available depending upon the nature of harassment, threats, cheating, blackmail, financial fraud, or other specific acts involved.

I understand your concern and the mental trauma you are going through. However, merely having a relationship or communication with your husband does not, by itself, give you a legal cause of action against the other woman. We first need to examine exactly what she has done and what evidence you have. If she has been threatening, blackmailing, stalking, harassing, sending objectionable messages, making false allegations, interfering through unlawful means, or attempting to extort money, appropriate legal action may be possible depending upon the facts and available evidence. Please preserve all WhatsApp chats, call records, photographs, audio/video recordings, bank/payment records, social-media messages and any other relevant material. Do not threaten or abuse her yourself. We can first examine the evidence and then decide whether a legal notice, police complaint, civil proceedings, or any other appropriate remedy is legally maintainable. We should base the complaint only on specific acts supported by evidence rather than general allegations that she is trying to spoil the marriage.

I understand this is very painful for you after 7 years of marriage. Legally you have strong remedies. 1. Adultery as ground for Divorce: Under Section 13(1)(i) of Hindu Marriage Act, 1955, voluntary sexual intercourse by husband with another woman is a valid ground for divorce. Supreme Court in Joseph Shine vs Union of India (2018) has decriminalized adultery, so you cannot file criminal case for adultery against that woman, but you can file divorce on this ground. 2. Cruelty: Under Sec 13(1)(ia) HMA, if husband's extra-marital affair causes you mental trauma, it amounts to cruelty and is also a ground for divorce. 3. What you can do: a) Collect Evidence: Keep WhatsApp chats, call records, photos, money transfer proofs showing your husband is involved with her. b) Legal Notice: Send legal notice to your husband to mend his ways and resume cohabitation. c) You have two options: If you want to save marriage, file for Restitution of Conjugal Rights U/S 9 HMA. If you want separation, file Divorce petition on grounds of adultery and cruelty. d) Against that woman: You cannot file criminal case for breaking marriage, but if she is blackmailing or extorting money, you can file complaint for extortion/blackmail under BNS. You can make her co-respondent in divorce case to prove adultery. It is advised to try mediation/counseling once and consult a local family lawyer with evidence.
