Yes, they can get married, but not under Hindu Marriage Act at Tehsil/Sub-Registrar level.Since it is an inter-faith marriage (Hindu-Christian), their marriage will be registered under the Special Marriage Act, 1954. The application is to be made to the Marriage Officer of the district (Collector/ADM/SDM Office).Procedure:1. Notice of Intended Marriage to be filed in the district where at least one of them has resided for 30 days prior to notice.2. 30 days notice period for inviting objections.3. On the appointed day, marriage will be solemnized before Marriage Officer with 3 witnesses and certificate will be issued.Documents required:1. Age proof - Birth Certificate / 10th Marksheet / Passport (Boy 21+ and Girl 18+)2. Address proof - Aadhaar / Passport3. Photographs - 6 passport size each4. Affidavit regarding marital status, nationality and non-relationship5. ID proof of 3 witnessesYou can apply online on IGRSUP portal in UP.

Yes, inter-faith marriage between Hindu and Christian cannot be registered under Hindu Marriage Act in Tehsil.It will be registered under the Special Marriage Act, 1954. You have to apply to the Marriage Officer of the District (ADM/SDM Office).Procedure:1. Notice of Intended Marriage will be given where one party resides for 30 days.2. 30 days publication period for objection.3. After 30 days, marriage will be solemnized in presence of 3 witnesses.4. Certificate will be issued.Documents Required: Age proof (Birth Certificate), Address proof (Aadhar), 6 Passport photos each, Affidavit of single status, and ID proof of 3 witnesses. Both should be of legal age - Boy 21 years and Girl 18 years.

Q: लड़की की शादी के बाद ससुराल मे हत्या कर दी गयी

जब मायके वाले गये ससुर तो उनको बताया गया की उनकी बेटी suside कर लिया, जब ये लोग घर के अंदर गये तो देखा की घर की छत इतना नीचे है की उसका पैर लटकने पर नीचे पहुच जाए और उसके मुह पर कुछ अन्दर चुभोने के छाले पड़े थे उसके पैर की एक उंगली कटी थी गर्दन पे किसी गरम चीज से चुभोने के निशान थे उसकी बेटी की बेटी ने बताया की उसके घर वाले ने उसकी माता को मारा है इतना होने के बाद भी उनकी पुलिस सुन नही रही न कुछ कर रही , ना कोई कार्यवाही क्योंकि उसके घर वाले उनको पैसे दिये है वो लोग गरीब और कम पढ़े है क्या करे

यह मामला प्रथम दृष्टया आत्महत्या का नहीं, बल्कि हत्या का लग रहा है।आपके द्वारा बताये अनुसार जब लड़की के मायके वाले उसके ससुराल गये तो उन्हें बताया गया कि उनकी बेटी ने आत्महत्या कर ली है। जब वे घर के अंदर गये तो देखा कि घर की छत इतनी नीचे है कि फांसी पर लटकने पर भी पैर जमीन को छू रहा था। मृतका के मुँह के अंदर चुभाने और जलने के छाले पड़े थे, पैर की एक उंगली कटी हुई थी और गर्दन पर किसी गर्म चीज से जलाने के निशान थे। मौके पर मौजूद उसकी छोटी बेटी ने बताया कि उसकी माता को उसके ससुराल वालों ने मारा है।इतना होने के बाद भी पुलिस कोई सुनवाई नहीं कर रही है और ससुराल पक्ष द्वारा पैसे देने के कारण कोई कार्यवाही नहीं हो रही है।*ऐसी स्थिति में आपको यह करना चाहिए :-**1.* आप तुरंत वरिष्ठ पुलिस अधीक्षक (SSP) को एक लिखित शिकायत रजिस्टर्ड डाक से भेजें, उसकी एक प्रति जिलाधिकारी और महिला थाना को भी दें।*2.* यदि थाने में FIR दर्ज नहीं हो रही है तो आप BNSS की धारा 175(3) के तहत माननीय न्यायालय में प्रार्थना पत्र देकर FIR दर्ज कराने की मांग कर सकते हैं।*3.* पोस्टमार्टम रिपोर्ट की कॉपी प्राप्त करें और घटनास्थल के सभी फोटो-वीडियो तथा बच्ची के बयान को सुरक्षित रखें। बच्ची का बयान बाल कल्याण समिति के समक्ष दर्ज कराएं।*4.* आप गरीब हैं तो आपको जिला विधिक सेवा प्राधिकरण (DLSA) से मुफ्त वकील मिल सकता है। आप राज्य महिला आयोग में भी शिकायत दर्ज कर सकते हैं।यह भारतीय न्याय संहिता की धारा 103 के तहत हत्या का गंभीर अपराध है।

Q: Regarding fraudulent Arya samaj mandir

I met a guy 6 yrs ago,my parents liked him. After a yr he asked me to 1st marry in arya samaj & i did & didn't tell my parents. My father before fixing marriage did background check on him, he turned out to be fraud. When he got exposed he ran away with my money. I then went to Arya samaj & told them that he gave a fake name & ID card & did this with multiple women. It's been 5 yrs. Can I marry without problem? I talked to a lawyer & he said that I don't need to nullify it & im legally unmarried

As per facts stated by you, your earlier marriage is not legally valid and is voidable.Under Section 12(1)(c) of Hindu Marriage Act, 1955, a marriage can be annulled if consent was obtained by fraud as to any material fact. Using fake name, fake ID and impersonation is a clear fraud as to identity. Also person who duped multiple women is a habitual cheater.You are NOT automatically unmarried. Even though marriage was done with fraud, the record of Arya Samaj Mandir still exists. To avoid any future legal complication in your second marriage, you must get a decree of nullity from Court.What you should do:1. File a petition for Annulment of Marriage / Declaration of Nullity before Family Court on ground of fraud. After 5 years of separation and his disappearance, Court will grant ex-parte decree.2. File Criminal Complaint: His act amounts to cheating U/S 318 BNS [Old 420 IPC], forgery, impersonation and outraging modesty. File FIR against him.3. Second Marriage: Once you get annulment decree, you will be legally free and considered unmarried, and you can marry again without any problem.Opinion of lawyer that you are automatically unmarried is not safe. Always take Court decree for safety. Consult local family lawyer with all documents.
