Mutual divorce, money spent in husband's property

11-Dec-2025 (In Divorce Law)
Hindu wife, no child, living separate since 4 yrs due to neglect & wrong behaviour from husband side. No earlier legalcase filed. Want mutualdivorce but wen we were livingtogether i gav my own money (many lakhs directly to contractor) in construction of husband's ancestral house. How to get money back legally? Am I entitled for alimony in mutual as I m unemployed? If I don't divorce & live separately, can I ask for maintenance? I never took any money till now. Hoping advice, not gender biased

✔️ Money can be legally claimed if evidence exists ✔️ Alimony is allowed in mutual divorce ✔️ Maintenance allowed even without divorce ✔️ Being unemployed strengthens maintenance claim ✔️ Recovery + Divorce terms can be negotiated together

replying to your questions:- 1:- You can file a money suit if you want your money back, but I will suggest to file a civil suit for declaration of rights in that property. 2:- You and your husband have to mutually make a decision for alimony in mutual divorce as there is no law for alimony in Indian Law, In English law wife can get up to half of the estate of Husband. 3:- Yes, you can ask for maintenance from your husband through family court, if you live seperately without taking a divorce
