In case of mutual consent divorce the question of your ex spouse going in appeal does not arise as the same is done with his consent before the Court. Feel free to contact me for seeking any legal advice as regards the same.

Usually, once the divorce decree is granted, it cannot be cancelled. However, in case you have violated the terms of the consent terms then the opposite party may approach the court for restoring back the case. If you require any further legal assistance, you can approach me directly.

Well, your Ex Spouse cannot go to Court now and get the Mutual Divorce cancelled without proving, that, he consented to Divorce you earlier due to any threat, undue influence, lure or misrepresentation of facts made by you.

Once the family court has passed the mutual consent divorce order, it cannot be simply “cancelled” by one party alone after the judgment, even if the decree copy is still awaited. Your ex-spouse would have to file a formal review or appeal, which is only allowed in very limited circumstances and within strict time limits. Unless there was fraud or serious legal error in the mutual consent process, the divorce will remain valid. I recommend a consultation so we can track the status of your decree and discuss how to protect your legal rights in case your ex attempts any action.
