Mutual divorce duration and child involvement

Dear sir/madam, Both me and my wife are living togther with our one daughter but we are living as parents and friends. There is no marital relation since last 5 years. We want to file for mutual divorce. How long will it take to get everything completed? We dont want to involve our child in any court hearing at all. Is it possible? We want to share child custody with each other i.e. staying with husband and wife visiting every week. Do we need to necessarily discuss this planning in court?

since you both want to take mutual divorce then you need to file an application/petition under section 13B of Hindu Marriage Act. Court after it will send the matter mediation and thereafter will give a date for second motion wherein it will give decree of divorce.

yes you both have to jointly move a petition under section 13B Hindu marriage Act before the family court and within 3 months from the date of filing this joint suit ,then divorce decree shall be allotted and for your kind information there is no role by the court to call the children inside the court overall if you want , you can present your schedule of child custody

yes it's possible. mostly in mutually divorce case take timing in 6 month cooling period. but we are wave of cooling period and get final order withing one month. and no need of child for any hearing. if all disputes settle out side the court. for more information you can contact me.
