Mere wife ka death unke hi mayake me baby hone ke bad ho chuka hai par unke mayake ke log mere 2 bachhe rakh liye hai wo dene ke taiyaar nahi ho rahe hai girl -6 years ka boy-2 month ka hai

Aapki पत्नी की मृत्यु ke baad aap biological father hone ke nate dono bachchon par aapka natural legal guardianship right hai (Section 6, Hindu Minority & Guardianship Act). Wife ke mayake walon ke paas bachche rakhne ka koi legal adhikar nahi hai jab tak court unhe legal guardianship ya custody provide na kare. Aap unse peacefully bachche wapas dene ka request karein, agar wo deny kar rahe hain to aap Child Custody Petition Guardian

on The above mentioned query please file immediately a suit for custody of the minors to the concerned district judge. and note down that the case files where there is the children resides usually. after admission of the case, the court send summon to the opposite party and after filling objection the case turns on evidence. thereafter cross examination and arguments. and thereafter the court if satisfied by your advocate then deliver judgement in your favour

for faster result you can file writ of Habeas corpus directly in High Court. High Court after considering the fact may order the state i.e. the police to produce your children before it on a certain date. you can also file for child custody in District Court. but this process takes time. one another method can be adopted which I will tell directly only
