Mental harassment by spouse since last 8 years

My sister has been married for 8 years & has a 6 year old girl child. She has undergone physical & mental harassment in last 8 years. We've tried a lot to explain & resolve matter peacefully. However, the mental harassment by him & his mother hasn't stopped. Also, the husband is incapable for physical relationship & hasn't been able to have that for last 5 years.
What can we do? Currently my sister has come to maternal home. However, she is scared if the husband who is very aggressive will come & create a scene to take the daughter.
We were planning to file a complaint with Woman Commission & then give them a chance to stop this behaviour. And if this doesn't stop, then file a divorce. Is this the right way to go?
on the above mentioned query it is not clear that the husband is incapable for physical relation from the beginning of the marriage or after the birth of the child for any medical issue. If from the beginning of the marriage, so the wife is going to the court for divorce with the reason that the husband is impotent. Impotency is the sufficient ground for divorce. But if he is any medical issue after the delivery of his wife, their is no legal remedy on the basis of incapability for physical relation.

hello , it is a right decision that you can file a divorce suit against your sister in laws but first of all write an application and send it to SSP of your city and a copy send to in Mahila Aayog
yes you file a complaint with women cell with this you also file a case for maitainance in family court. start doing mediation in all cases. if problem still exists you may file divorce and go with maitainance case to gather. for more brief u may call me in case of need
you can straight away file a divorce petition. if both parties are in agree then you can mutually file it under section 13b and if both parties don't agree then you have enough grounds for also filing it under section 13.
