looking to file for divorce - mutual consent divorce remotely........

11-Apr-2025 (In Divorce Law)
I’m an Indian citizen living in Calgary. I was married in New Delhi under the Arya Samaj in July 2023. I’ve been physically separated since Sept 2023, and we’ve agreed to a mutual divorce. Can you assist me with the process?

Yes, I can certainly assist you with the mutual divorce process. As per Indian law, for mutual consent divorce under Section 13B of the Hindu Marriage Act, you need to complete one year of marriage before filing. Since your marriage took place in July 2023, you’ll become eligible to file around July 2024. Both parties must file a joint petition and appear before the Family Court in India, typically twice—once at the time of filing and once after the cooling-off period of six months. I can guide you through the process and documentation, and also help with remote appearance options if needed.
