Looking for information against false dowry
15-Jan-2025 (In Divorce Law)
Hi, I am living in Canada but i am Indian citizen but my wife recently got canadian citizenship. My question is if i go for a divorce and file the same in Canada, can my wife or her family members (living in India) file false Dowry case in India against my parents?
Yes, your in laws can file a police complaint against you and your family even if your are residing abroad, at present. After the CAW complaint is filled the parties are called for counselling and if you fail to represent and defend yourself for the same. Then a FIR can also be registered against you and your family.
In order to provide more precise advice, I would appreciate if you can share more facts of the situation.

In India, dowry-related cases, including false claims, can be filed under Section 498A of the Indian Penal Code and the Dowry Prohibition Act, regardless of the location of the divorce filing. Your wife or her family members may still file such cases against you or your parents in India. However, these cases would need to be proven in court, and baseless or false accusations can be contested.
It is advisable to gather evidence to safeguard yourself and your family, such as communication records, financial transactions, and any other relevant proof. You should consult a legal expert in India to help you prepare a strong defense and guide you through the legal processes if such a case arises.
If the divorce is filed in Canada, ensure that it is valid under Indian law, as international divorces may not always be recognized in India without additional legal steps.
Yes, it is possible for your wife to file a dowry case/dowry demand harassment case in India. Though she has acquired the citizenship of Canada, she can still file a case against you and your family for dowry in India - even if that incident arose in Canada.
