Now I need to know the amount approx 3 lakhs which he has pay plus alimony amount. But he is not coming, how will I get divorce? How will I get alimony and maintenance amount as he is not coming? How I can get benefits from court in such situations? I am cancer patient also. What should I do that I will get benefits?
Advocate Y Asenla Pongen answered
You can request the court to issue arrest warrant against your husband/ attached husband’s property to recover the amount. There is also the option of approaching the high court with an application in such scenarios.
Q: Want to have Child custody or visitation rights
I am a divorced NRI with an ongoing 498a case. My wife has filed a case under "guardian and ward act, 1870; section 7". She wants sole custody of my daughter (she is a US citizen) in order to re-issue daughter's passport. I don't want her to have sole custody and I am in the US right now. What are my options?
Advocate Y Asenla Pongen answered
For now, the immediate measure you can take is filing a habeas corpus in the high court so that the child is produced before the court and make submission of your interest to be in the child’s life. There are of course other things to be considered of the cases that is going on in the lower courts and how to navigate through it. Nonetheless, the immediate step can be filing the habeas corpus. If you be interested in how to go about it, you may reach out to me.
Q: Many underage convicts were released one was not. Remedy?
A 16 year old boy was convicted of murder in 1994. After the Hon'ble Supreme Court order, many underage convicts of murder were released by the state government and that 16 year old was not. He went on to serve a life sentence(14 years). What can be done in this matter now? Any remedy?
Advocate Y Asenla Pongen answered
There are several judgments that says that a Juvenile cannot be judged as an adult even in murder cases, hence, the sentence is to be reduced. But he has already served 14 years and not yet released. In the present scenario, we can approach the court stating provisions under Juvenile Justice Act praying for his release on the basis of he being a minor at the time of commission of the crime.I can assist with that, so you can get in touch with me to take it further.
Q: Can i send statement to IO via post, email and whatsapp (no 41 notice)
Wife filed false FIR 600 kms away(with no evidence) sections 498A, dowry (3 & 4), & 506. she claims me & my father demanded dowry, abused her, and threw her out with threats to kill (though my father was in another city that day). WhatsApp chats reveal her real motive was to separate me from my father & to take revenue of my police complaint. The IO is threating me & calling me for signature & statement. Can I send statement on affidavit & video? Io not serving 41 a notice. can she arrest us
Advocate Y Asenla Pongen answered
As stated, the police need to send you the notice. If he is not sending you the notice and threatening you, it might be save to assume that they might want to extract money from you (not certain). You first have to determine if the FIR is registered or not. It will be safer to go with a lawyer and then determine if the FIR is registered or not so that they don’t bother you unnecessarily. Then move forward from there. Also, you can send your statement by post, though there is no such procedure. But as stated above, the first step is to go see if the FIR is registered or not. And if you have a lawyer, there won’t come a stage where they are threatening you. Everything can be done according to the right procedure.
Q: Am i eligible for maintenance or not? and how long it will take ?
If wife wants to file for divorce on the basis of compatability issue, like abusive behaviour of husband (working in army), anger issues, not giving her monthly expense though the wife is self dependent. How much take it long to get divorced and will she get maintenance though the wife is working. In my case husband is asking for 22 lacs rupees, dowry was not given but the whole expense of marriage and engagement were taken care by bride's family.
Advocate Y Asenla Pongen answered
To answer your query, it depends on how much your wife is earning. Does she have children of yours in her custody who she needs to take care of. All those factors will be taken into consideration. Also, how much you are earning.Divorce can be definitely filed, if it is a mutual divorce it should take upto a year, a little longer if it is contested.Marriage expenses made by the wife’s family should not be a very being problem here. For further assistance, you can get in touch with me.
