Legal procedure for divorce from wife and legality of increasing rent

Dear Sir/Madam, I don't want to write more. I have two cases in my life. If possible please me. First one is divorce Case...And Second one is Property matter... In the matter of divorce case..It's almost done 8 to 9 years for Marriage..And she is not in touch with me since last 5 to 6 year. Please suggest me what can i do in this matter. Secondly we have 5 shops in village, Currently 4 are in use and one is closed..It's joint property. Can we increase rent ? or not? Please guide me..Because they are paying 79/-Rs. or 90/-Rs. Per month..They are ready to sell it, But they are not ready to give us back. in this case please guide me what can i do? If possible help me, Currently i am not in institution to pay your fees. But if it will solve then i am ready to pay the amount to you whatever the amount will be there..I will.. Market Price 40 to 55 lac per shop..But i think we will not get our shop back..That's why we are not ready to sell it.. And in last we are getting Rent 79/-R

The question involved for two cases. But you have not written that where you are staying nowadays. As you have not mentioned the name of your place the answer of second question cannot be given. In first case you may file Divorce case if anything is not working towards resolving the dispute between you and your wife.

You can file divorce case as you are seperated from last 5 to 6 years .
So far as your property matter is concerned you can file case for increasing rent as per new market rate or for taking back possession of shops. Meanwhile if the parties are ready for the compromise , you can do that if parties agree with handsome amount.

For Divorce you have to file divorce petition under HMA before the court. For second you approach before the Rent controller for fixation of fair Rent. Or if you want eviction then eviction suit on ground of personal necessities.

For the first point of divorce, you have a very good n valid ground to apply for divorce. If your wife is contactable, it would be wise n legally correct to take her consent for easy divorce.
As regards point No. 2, certainly you can revise the rent. So far as sale of shops is concerned it's upto your sweet will to sell at your price.
In both matters no advocate can help without fee. If you pay my fee I m ready to help you.
