Is it necessary to put respondent's photograph in divorce petition

Is the spouse passport photo not necessary for filing a contested divorce petition ? My advocate did not attach my husband's photo, saying it is not necessary. What would happen when the photo of the respondent is not pasted on the petition ?

Dear client,

It is necessary to paste recent passport size photograph with tue mutual divorce petition for both the parties.Dear client On first date the judge can raise the objection regarding this asked ur husband to carry on the court date.Dear client for more clarification u can contact me and I m happy to help u.

It would be better if you approach the registry of court as they can explain you better as to what happens in case photograph of respondent is absent. As a normal practise, if petitioner does not have the photograph then he is asked to file an application seeking exemption from filing the same. But it would be better if you approach the concerned registry and seek clarification in this regard.

This is only a procedural defect. As per the rules, it is mandatory to attach your husbands photograph. However, it can be easily explained that at the time of filing the divorce petition, you did not have access to your husbands photograph and only upon serving notice ( where the Judge instructs your husband to appear before the Court) that your husband should be instructed to provide his photograph.

It's not a big issue. Your lawyer should be able to handle it. Otherwise, there is enough support here at lawrato.

it is the court who has to ascertain the facts and circumstances of every case and also to ascertain the identity of the petitioners. till the time the court is not objecting, it is not necessary. Although i would suggest that you must past his photo also on the petition
