I want to file an divorce against my wife

I am married for last two years. My wife is a State Govt employee and myself is a central Govt employee. For job we are staying different state. For last one and half year she did not keep any relation and she is staying at her parental home. I also come to know that she had an affair with her colleague before marriage which continues after marriage also. I have collected some proofs regarding the affair. She also made false complaint to my department to demean my image. I want divorce from her. Please suggest my further course of action.

if you wish to file divorce petition against her she will rope you in false cases of maintenance and take humongous amount of alimony so you need to think a lot before filing divorce and your situation needs to be understood properly. Today adultery has been struck off so your wife will not be punished for having an affair

don't worry about it... i will suggest you to lodge a complaint a criminal case against your wife's lover Under sec 497, he will be punished for two years imprisonment and then you can take divorce and by doing this you can easily get divorce from your wife. You can always file a divorce petition but prior to that send an Advocate notice to your spouse. If your wife agrees with you then you can file a petition on mutual consent and if she disagrees then you have to contest.

In my opinion you can file a case under section 9 of the Hindu Marriage Act for restitution of conjugal rights .
And If you have evidenced of her extra marital affair then you can file divorce petition before the court.
And without detail discussion proper consult is not possible.

If you are Hindu and governed by Hindi custom and marriage was solemnised and registered under Hindu marriage act then you have to file matrimonial suit under section 13 of Hindu marriage act on the ground or desertion
