yes of course you can claim the gifted property under 125 crpc. all the properties belongs to your husband will be calculated at the time of passing order by magistrate for the maintenance of wife and child.

sorry to say but you can't marry again as long as your first marriage exist irrespective of your wife is living with you or not. First you need to get divorced from your wife and then you should plan for second marriage otherwise you will infringe the Indian law and may be punished by court of law.

You have to file civil suit and take injunction on the disputed property. only 144 is not enough to get the justice regarding the property matter, because the executive magistrate has no such power to handling the matter properly regarding immovable property.
