I have no evidence of my marriage Can I file for divorce

 A boy age 20 and a girl aged 18+ but below 20 got married 4 years ago its a love marriage and their was no evidence that they got married but they were . they lived together for matter of 6 months and girl was pregnant like 4 to5 months and she got aborted . now it as been 4 years they are not living together . the boy want to giver divorce will he get.?

if you have no any evidence of your marriage however you can file divorce petition. with divorce petition annexed a affidavit of marriage. Evidence means not only marriage card or marriage certificate but your family and society are also a evidence of your marriage.

Well you can file divorce petition before family court as per Hindu law you are hudband and wife if society recognise you as husband and wife there is no need for any certificate but as per Hindu precondition for marriGe is 21 and 18 year on the other hand as as per cutom prevailing in tribe whatsoever now one thing is clear that you can go for divorce mutual.I. further details regarding law contente

If you are sure there is no proof of marriage then there is no need for a divorce. Unless they both agree that there was a marriage, then they can move the courts for a divorce. You will need to speak with the opposite party before you take any step or else you could be in serious trouble.

Hi,

Firstly, there must be some witness also to prove their marriage i.e. the priest who have performed those marriage rituals.
Secondly, it can be registered today also to get divorce because it is necessary for you to provide your marriage related evidence in the Court which could be the photograph's of the wedding day,someone who had attended your wedding as witnesses(friends) etc.
Rest can be taken care of. If your wife is ready then in that case you can get mutual divorce easily.
