Husband not accepting the Maintenance summon

10-May-2025 (In Divorce Law)
I have filed maintenance case against my husband. He stays in USA but his parents are residing in Mumbai.. His family in Mumbai has not accepted the Summon sent, so now the summon is send by the court through registered post to the Police and the summon will be served through Police. My Question is What if the family members of my husband residing in Mumbai still do not accept the summon ? What should be the next procedure/ step ?

If you have your husband's email id or some other contact information, you can try serving him through that mode. There are other provisions also to serve your husband at US. Feel free to contact me for seeking any legal advice as regards the same.

Well, if the family members and parents of your Hubby won't accept the Summons from Court, then, the case may proceed on Ex Partee, if after service of Summons on your Hubby via his parents won't convince him to appear before court and as such, he does not appear, Case will proceed Ex Partee and an Ex Partee Order of Maintenance can be passed in your favour.
