Husband files divorce on visiting parent's home

Married on 18 June 2017. Father-in-law initially told, he is against dowry but wished marriage to be done according to their standard. After, Roka was done, ladke-wale started demanding Cash & jewellaries on ceremonies on grounds of their reputation. On the day of marriage, they demanded cash Rs 2 Lacs, saying they will avail me of fridge, TV, washing machine etc from this cash. But they failed in their commitment. After a month of marriage, my parents visited matrimonial home to take me following a custom. My in-laws happily permitted me to go. After I came to parent's home, the very next day, husband started coercing me for divorce. He said he thinks "ki hamari shadi aage tk chal nahi payegi, isliye divorce le lo". He said " I want you to quit job and sit home and don't visit/call your friends, siblings and relatives. He made me stay in my parent's home and filed for divorce after 1 year of marriage. I am Hindu and want to save my marriage. Please suggest what to do.

Dear client,


First of file CAW cell complaint against ur husband and ur inlaws for registration of FIR under section 498A and 406 IPC. Mam u can also file section 9 Hindu Marriage Act which deals with asking ur husband to live with you. Mam u can also file Domestic violence act case against ur husband and ur inlaws. Hi,

Based on the facts you have shared, if you still want to continue with the marriage then there is legal remedy in the form of “Restitution of Conjugal Rights” available under the Hindu Marriage Act.

But going by your statement, he filed a divorce petition around post June 2018, correct? So you must have received the notice for appearance. Don’t you have an advocate representing your case in the Court?

you can send them a legal notice to for restitution of Conjugal Rights if they'll not give any positive reply to that, you can file a case u/s 9 of Hindu Marriage Act for restitution of Conjugal Rights if you really want to live with him.
