If your husband is ready to join the petition under section 13b of Hindu marriage Act for divorce on the basis of mutual consent then you need to go to the concerned court of principle judge family Court with your ID proof, marriage proof and residence proof. You can file a suit for divorce on the basis of mutual consent. The court would fix a date for the second motion. After second motion if both the parties agree, the court will dissolve your marriage by passing a degree for dissolution of marriage on the basis of mutual consent. Dear Client, You should file a section 13B of the Hindu Marriage Act for the purpose of Mutual Consent Divorce, and if you need maintenance, then file section 125 Cr.P.C then court will grant monthly maintenance.

As per section 13 (b) there is provision of divorce by mutual consent under hindu marriage act 1956. The procedure succinctly here on text would be a bit lackadaisical as well as byzantine to demonstrate. The only thing in brevity I can tell that when both the parties mutually have no quarrel to get saggregated the course of 6 months in the family court will be there. Further more 1 advocate on your part & 1 advocate on your. husband part will happily get you separated.
