How to settle divorce case? Not coming for mutual divorce.

05-Jun-2024 (In Divorce Law)
My wife filed sec9, I filed sec13 1 ia. Court counseling failed. No kids. She worked before separation earned 1 lakh per month. I have job with salary upto 2 lakhs per month. No property. They are not coming for mutual divorce, not continuing marital life. After few moths passed I decided not ready to continue with her. They stretching the case for more than 2 years now. Asked 1cr for settlement. But we cannot afford that amount. Can we quash her petition in High court to get divorce quickly?

If your partner is also working then she will not be entitled for any maintenance. And if there's no scope of living together then rather stretching the relationship you should go with mutual divorce because it's cost effective and ends up in a maximum of six months.

petition under section 9 of Hindu Marriage Act is file for restitution of conjugal right petition can't be quashed, I have a suggestion for you when her petition is being taken by courts, you may join the proceedings and agree with the judge that I will take her at home and will live peacefully. in this way you can settle it.

you need to file divorce petition under Article 142 in the supreme court, the court will consider the relevant facts ,and if there is impracticable to continue the marriage, the court will grant divorce, this power is only in supreme court
