To defend against the maintenance case and quash her petition, follow these steps: 1. Contesting Maintenance Claim: Prove Her Independent Income: Since your wife is a graduate and working in a private company, gather evidence such as her salary slips, appointment letter, or bank statements. If she denies employment, file an RTI with her employer or seek court directions for salary proof. Highlight Desertion & No Justifiable Reason: Emphasize that she voluntarily stayed with her mother for two years without a valid reason and that you never neglected her financial needs. Show Financial Burden: Submit proof of your existing financial liabilities, such as loan documents, EMI deductions, and monthly expenses, to demonstrate that you have limited disposable income. 2. Defending Against 498A & Other Sections: Collect Evidence of False Allegations: If you have call recordings, messages, or witness statements proving that she is misusing the law, present them in court. File for Quashing: Under Section 482 CrPC, file a petition in the High Court to quash the 498A case if there is clear evidence of false accusations. File for Anticipatory Bail: If required, seek anticipatory bail to prevent arrest. 3. Counter Legal Actions: Defamation & Perjury: If she has made false statements, file a case under Section 211 IPC (false charge of offense) and Section 500 IPC (defamation). Restitution of Conjugal Rights (RCR): Under Section 9 of the Hindu Marriage Act, if you wish to bring her back, file an RCR petition to show that she left without a valid reason. Child Custody & Visitation Rights: If you have a child, seek visitation or custody under the Guardians and Wards Act. Would you like assistance in drafting the petitions or gathering necessary evidence?
