dear client if both the party agree to get divorce then only one can file divorce for mutual consent otherwise you have to proceed for regular divorce petition in family court for further details do contact us

first your brother should amicably settle all the issues with his wife regarding maintenance, Alimony etc then file a joint petition for divorce on mutual consent basis before the family court. After filing the petition the concerned family court will give your brother six months date for reconciliation. Thereafter the concerned family court will record the statement of both the parties then court will grant divorce decree.

Consensual divorce is better than contested divorce, ask your brother to meet an advocate of his choice in your circle and tell him to file a mutual concent divorce petition under section 13B of Hindu Marriage Act, both the parties must consent to move in court for seeking divorce and rest procedure your advocate will guide you.
