Before filing divorce you should secure custody of Child by filing a case for custody which will go long way in ensure divorce.You should also seek remedies under Protection of Women under Domestic Violence act.As atrocities are not describe by you Its difficult to gauge Criminal options.

Hello

There are two ways to go about it 1. A divorce take with mutual consent 2. A divorce contested against the spouse. In both cases it will take approx one year time including separation time. Custody preoceeding will move simultaneously.

You can file divorce in different heads according to Hindu Marriage Act, But you can tell me specifically what your grievances are against your family members.
You can get a maintainance as well for your child as well.

You can first put the complain against them so they are under pressure.
Secondly file a writ for divorce and child custody. Also collect all the relevant materials which are in favour of you to get the child custody.
