You are under obligation to maintain your wife as per your standard of living. However, if she is capable of earning, you do not have to take the responsibility of maintaining her. And as far as your net worth and monthly income are concerned, my suggestion would differ on case to case basis. For better and precise answer, I need more elaborated detail.

Is your divorce a mutual divorce or a contested divorce ? has your wife filed for a 125 Crpc appliances before the court ? will need to see you case file to advice you further. however, the issues of maintenance, how much etc is decided by the court not by you.

Maintenance amount gets decided by the court as per the living standard of the husband and the requirement of the wife to maintain herself. There is no fixed formula for deciding maintenance case, rather it’s a circumstantial basis. If any unjust amount is being forced upon you then you may contest the same and prove your case. While deciding a case of maintenance the Court will examine all the relevant details. Yoh have provided very limited information here. It's better you meet us in person and discuss your case to get justice. Brij Mohan (Adv.)

While deciding a case of maintenance the Court will examine all the relevant details. In case case of maintenance under section 125 CRPC or under the domestic violence complaint the court will consider your income, earning capacity of both, assets in your possession, standard of living as well as financial status of the family. Would advise you to seek a detailed consultancy from a lawyer and clear your doubts and formulate a strategy.

See your fathers income cannot be considered as your income. If you have valid proof of your current income then the maintenance would be determined from your income only. Further, even if you are staying in your father’s house or driving your father’s car, then also it would not be an issue. We need to prove your credibility before court so that court understands that you are only using the amenities of your father but meeting yours and your wife’s expenses from your own income. Then only you can avoid payment of high maintenance to your wife even if she claims Rs. 5,00,000 as your monthly income.
