Hi,nWe married in 2021. We don't have any child. I am living in delhi. My husband is working as an officer in public sector bank in MP. His net monthly salary is 60000/-, out of this he is paying 10000 as car loan and 22000 in personal loan which has been taken by him before marriage. In this case, how much monthly maintenance I can claim?nPlease guide

calculate all your expenses like medical travel food clothes etc and than just file maintenance case.. if you go with us than it can be 20k..as you lives in Delhi contact us we are expert is such cases.

If after marriage the husband and wife have no children and they are looking to divorce each other or either one of them is willing to divorce the other one, then the alimony in such a case may be lesser than the case where a child is involved. However, if the husband denied completely accepting the wife then this cruelty to the wife may be enough to convince the court.

There is no set formula prescribed for claiming maintenance. It depends upon your expenses which you will entail for your subsistence. While granting the interim maintenance the court will take into account certain things like your education, earning capacity, your spouse income, expenses, standard of living etc etc.

You claim according to ur expenses and don't worry about his liabilities and expenses court will decide after getting affidavit of income from both the parties If u r not working court will decide accordingly first u will get interim maintenance and then permanent maintenance will be decided

However, the Supreme Court (Rajnesh V Neha) has listed out guidelines and principles to guide all the family courts while deciding on the quantum of maintenance. You and your spouse will be required to file an income affidavit declaring all your assets and income after which the court will decide the quantum of maintenance.
