Getting proof of secret marriage of husband

18-Feb-2025 (In Divorce Law)
After 32 years of marriage, I came to know that my husband got secretly married to someone 15 years ago. I only have , as a proof, PAN Card of that lady showing his name as her middle and last name. And they are living together secretly from so many years, Can I file under RTI, what documents are provided to update her name in PAN and Adhar cards? And from where? Can I get the information, without their knowledge?. I need proof first to confront or proceed legally. I belong to Hindu religion.

Yes, you can file an RTI (Right to Information) application to gather evidence discreetly, but some details like PAN and Aadhaar data are protected under privacy laws. Here’s what you can do legally to obtain proof of your husband's second marriage and proceed against him: 1. Gather Evidence Discreetly Since you only have her PAN card, you need more proof of their relationship, such as: Marriage Certificate (if registered) – Check with the Registrar of Marriages in their suspected city. Ration Card/Voter ID/Aadhaar Details – If they are living as husband and wife, she may have used his name in official records. Bank Records/Joint Accounts – If you can legally access his financial details, look for transactions linked to her. Property Records – Search land or house ownership records to check if he has bought property in both their names. 2. Can You File RTI for PAN/Aadhaar Details? PAN Card Update Records: You can file an RTI with the Income Tax Department asking: What documents were submitted to update her name? From where was the PAN card issued? Aadhaar Update Records: UIDAI does not disclose Aadhaar details under RTI due to privacy rules, but you can check if her Aadhaar has his name as a spouse through indirect means (like trying to link a ration card). Marriage Registration Details (RTI with Marriage Registrar): If they legally registered their marriage, an RTI to the Marriage Registrar's Office in their city can confirm it. 3. Legal Action You Can Take Once you have proof, you can: File a Case Under IPC 494 (Bigamy) – Since you are Hindu, a second marriage during the first wife's lifetime is illegal. File for Divorce on Grounds of Adultery & Fraud – Seek compensation and alimony. Claim Your Right in His Property – Ensure he does not transfer assets to the second wife. Would you like help drafting the RTI request or legal notice?
