Foreign married to indian looking for divorce amd custody

Looking to file for mutual divorce. My 3 year old son and I have foreign citizenship. Would I get sole custody? Or can my husband fight for it? We are currently residing india but living with him its unbearable due to cultural differences amd impossible ezpextations put on my shoulders. I have no friemds or family support here. Can i take my son and go back to my country and get any maintanance for me or my son if i domt work right now?

Mutual divorce or divorce by mutual consent means when the legally wedded husband and wife mutually agree to dissolve their marriage as they are not able to live together anymore and they jointly present a mutual divorce petition before the honourable court without putting forth any allegation against each other.

As you have mentioned in your problem that you are a foreign citizen and you are married to an Indian resident. You also have a 3 year old son but your husband is leaving you and living separately. You are not doing any work at this time. And want to come back to your country because I am your husband's cultural and And there is an ideological difference, if you want that your husband should provide maintenance for you and your son so that divorce can be achieved by mutual consent, then you can file a petition in the family court to get divorce from your husband by mutual consent. You will get a good amount of money in the form of permanent alley money
