मेरे पति मुझे मानसिक रूप से torture करते हैं और कहते हैं कि वे नौकरी छोड़ देंगे ताकि मुझे भरण-पोषण (maintenance) न देना पड़े। क्या भारतीय कानून में मानसिक यातना को भी घरेलू हिंसा माना जाता है? अगर वह जानबूझकर नौकरी छोड़ देता है तो क्या कोर्ट फिर भी उसे maintenance देने का आदेश दे सकती है? मुझे Domestic Violence Act और Maintenance के तहत क्या कानूनी कदम उठाने चाहिए?

मानसिक उत्पीड़न (Mental Cruelty) को भारतीय कानून में घरेलू हिंसा (Domestic Violence) माना जाता है। यदि पति लगातार अपमानित करता है, धमकी देता है, मानसिक तनाव देता है या जानबूझकर आपको आर्थिक रूप से असुरक्षित करने का प्रयास करता है, तो यह Protection of Women from Domestic Violence Act, 2005 के अंतर्गत कार्रवाई योग्य है।

Hi , I am freelancer and Search for project on Freelancer.com platform. Recently I got to connect with one person . He post a project and i bid on that project. He shared his email to me in his freelancer chat. He email me his telegram id and later conversion happen in telegram. In telegram , he offers a deal to me that he will post the project in freelancer of amount 16000 with milestone 3000 and 13000. and in return i have to give him the 12000 amount through the QR . पुलिस में FIR दर्ज कराएं – भारतीय न्याय संहिता (BNS) की धोखाधड़ी एवं छल से संबंधित धाराओं के अंतर्गत FIR दर्ज कराने का आवेदन देंकानूनी नोटिस भेजें – यदि व्यक्ति की पहचान, ईमेल, बैंक विवरण या अन्य जानकारी उपलब्ध है, तो अधिवक्ता के माध्यम से धनवापसी (refund) हेतु कानूनी नोटिस भेजा जा सकता है।

हत्या, बलात्कार, भ्रष्टाचार या समाज के विरुद्ध गंभीर अपराधों में केवल समझौते या शपथपत्र के आधार पर कार्यवाही समाप्त नहीं की जाती। मामले के तथ्यों और आरोपों की प्रकृति का विशेष महत्व होता है।यदि मामला समझौता योग्य प्रकृति का है, तो हाई कोर्ट में धारा 482 BNSS (पूर्व में धारा 482 CrPC) के तहत FIR/चार्जशीट निरस्तीकरण (Quashing) याचिका दाखिल की जा सकती है।

केवल समझौता हो जाने से पुलिस स्वतः जांच बंद करने के लिए बाध्य नहीं होती, विशेषकर यदि आरोप गैर-समझौतायोग्य (non-compoundable) अपराधों के हों। किंतु यदि हाई कोर्ट का स्पष्ट स्थगन/रोक आदेश मौजूद था, तो चार्जशीट की वैधता को चुनौती देने का मजबूत आधार बनता है।सटीक राय के लिए हाई कोर्ट का अंतरिम आदेश, एफआईआर और चार्जशीट की प्रतियां देखना आवश्यक होगा।

Hello Sir Matrimonial case me section 9 ka judgement 4/2/2025 ko aya tha or uski decree 17/2/2025 ko bni thi. Decree pr judgment date 4/2/2025 h or decree date 17/2/2025 likhi h. Q- ab pati ne section 13 (1a) (ii) me divorce 9/2/2026 ko dala hai. Kya 1 year complete ho gaya tha? Agar judgement ki date dekhe to time pr dala gaya hai agar decree date dekhe to 1 year se pehle dala gaya h. Kya judgement date mani jayegi ya decree date. Plz sir Sahi answer dijiye Thanks

इस स्थिति में सामान्यतः “decree date” को महत्व दिया जाता है, केवल judgment date को नहीं।यदि Section 9 HMA की decree 17/02/2025 को तैयार/साइन हुई थी, तो Section 13(1A)(ii) के तहत divorce petition दाखिल करने के लिए 1 वर्ष की गणना प्रायः decree की effective date से मानी जाएगी।
