File for divorce in a hindu marriage

23-May-2023 (In Divorce Law)
I m working in a PSU and my wife is working as Assistant Director in FSSAI. We have a 9 years old daughter. We got married on 25th April 2012. Since then it is her usual practice to go and start living with her mother as my father in law died before our marriage. We had fights several times on small issues due to which she starts to hit me and then I hit her. After each episode she leaves me and went to my inlaws house and then came back after 4-5 months or more when I went to take her back. During these 4-5 months of each episode she blocked my call WhatsApp. I tried to contact her but wasted. Now she is living separately from last 4 years by taking court agreement of her house with her landlord. Ofcourse she came during these 4years often or I went to her house but we never have physical relationship from last 5years. Is this can be ground for divorce. What are the chances of alimony as we both earn equally.

you have very solid reason for divorce as you both earn well and she is living alone and all the things you said .. it's clear that she don't want to live with you as you have daughter too soo if she is ready to live with you then .. and if you don't want to live with her what about your daughter .. these are some facts we have to discuss and don't worry you have very strong reason for divorce ...

dear client as per your query I can only suggest you that if you both want to live together go for it or if not then you can go for mutual divorce if both of you are agreeing in case of alimony it would be better you discuss about it mutually because of your daughter you have to get her financially sound as being a father for future paid consultation please contact us with your relevant documents

Hello... Yes you can file for taking divorce in your district court...this can be ground for divorce...even you both can go for divorce by mutual consent in which divorce can be granted with both person's consent... As she is independent for she would not be able to claim much maintenance but there is a chance that your daughter can claim maintenance and to which you will have to fulfill it... For more information call/text me.. Thank You...
