Yes, divorce can be applied if one of the parties doesn’t want it but you should have strong grounds to present why you want a divorce along with the evidence to prove that ground. If you are taking the ground of mental torture that amounts to cruelty which is a serious ground therefore if you have sufficient evidence to present the mental torture then it the petition to divorce can be justified
Yes it can be done you have to file for contested divorce in court , the court will take legal action and the opposite party have to file a written statement and than further there will be evidence and arguments for further discussion please come for a meeting for better guidance with all your documents.
