False 498A 3/4 under Hindu Marriage Act

30-Jan-2023 (In Divorce Law)
Hello, I have been going through a false 498a case. Over hearings the opposition was not able to present any proof of Dowry as well as physical injuries as they claimed over the FIR. Plus wife is not ready to continue with me. On basis of that I got bail and Judge ordered us to close this case by filling Mutual divorce within months but the opposition is not ready to do so and looking for money. My lawyer says that there is no law for husbands in 498a case that can save husband from giving money or facing the trial if wife is not ready to continue or for mutual settlement even after the ORDER of court to close it. I want to ask that in our Judiciary system are there no law by which COURT can take action against wife for disobeying the COURT ORDER and presenting a false FIR??

Dear client, I have seen your query carefully and found that you have got bail in the section 498A IPC and 3/4 dowry prohibition act but your case is already pending. if the court accutal you in that case on the ground that the allegations are false and fabricated then according to the recent judgment of supreme court you will have a solid and valid ground for divorce. In your case you should try to settle all the issues mutually between you and your wife and file a petition jointly for divorce on mutual consent basis. if you want divorce but your wife is not ready for the divorce then you have to prove the allegations and grounds of divorce petition according to the provisions of the evidence act. you have not disclose the exact wording of the order of the court. so without knowing the exact details and facts of the matter no competant lawyer can give you proper advice so please disclose all the details of the matter. you can contact me for further assistance and advice on my contract number or email address through the administrator of this website
