Domestic Voilence and maintenance case

23-Sep-2023 (In Divorce Law)
My husband is serving in Indian army in non commissioned rank and i am pursuing phd, and getting a monthly stipend. From the very first day we are in long distance marriage and he is being physically and mentally abusive. He is having multiple affairs. After 3 months of marriage, i filed an FIR for DV and dowry, but after six months i took back the case, because he made false promises during counselling sessions and i believed on him but in written he didn't give anything. Now he is repeating.

dear client as per your query I can only suggest that if he is repeating the same as on what grounds you took your case back was it on some compromise or settlement if still his family members support you and amicably the things can be solved it will be better for future paid consultation please contact us with your relevant documents.

So you should again file a case against them for new cause of action and, this time, be careful about that and you have an idea about your past experience, so file FIR and other connected cases against them.

13B Divorce by mutual consent. — 1. Subject to the provisions of this Act a petition for dissolution of marriage by a decree of divorce may be presented to the district court by both the parties to a marriage together, whether such marriage was solemnised before or after the commencement of the Marriage Laws (Amendment) Act, 1976 (68 of 1976)*, on the ground that they have been living separately for a period of one year or more, that they have not been able to live together and that they have mutually agreed that the marriage should be dissolved. 2.If he has started such process again then the doors of justice are still open for you and talk to me for more information. you will be fully supported
