Domestic violence,finding faults without any reason.

Husband wants divorce.He is not ready to change his behaviour.In spite of having a baby,he is firm on his decision.

Dear Client,

Do claim maintenance from your husband for itself as well as for your child. If any kind of physical assault is associated with his act then you are highly advised to file a complaint before the Mahila Thana.

In matrimonial cases generally the easiest way to solve is to refer the dispute to mediation/consultation proceeding. You can also apply to Women’s Commission. But if you want to a divorce, then you are legally entitled to maintenance u/s. 125 CrPC. Contact for more details.

what do you want? If you don't want to agree for divorce on mutual consent then you should file the petition under section 9 of hindu marriage act for restitution of conjugal right if you are living separately from your husband in this petition you can file an application for maintenance under section 24 of Hindu Marriage Act for legal expenses and fees of your lawyer along with maintenance amount for the period of pendency of the case for your self and your baby if your husband file any petition for divorce then you should contest the on marrit if the court find that the grounds of divorce are not sufficient then his petition will be dismissed if you want any further information or any other advice then contact me without any hesitation through administrator of this website for my contact details
