Divorce to wife who never lived with husband.

31-May-2023 (In Divorce Law)
So, one of my friend got his marriage registered without any ceremony or rituals under Hindu marriage act. The girl arranged all the paperwork. They never lived together. It's been one year. Now when the guy wants divorce. She keeps saying since our marriage was not proper and we never lived together. I will say you frauded me and raped me and I will file case and say that since we were not properly married, you will not get divorce. nnIs the marriage valid? Can I get divorce? Can she file rape charge on the guy.

if any merriage is registered then it's valid. no one can say the merriage is not valid. Because the merriage registration is also thè proof of merriage. she cant file rape charges. your merriage can be desolved by the court order it is called divorced

if you have any doubt that your marriage is not proper or not completed then why you stay with that girl continued. you can leave that and file a complaint in police station that girl is forces you for living together otherwise she charge you for rape case. but if you happy with her then no need to proper marriage. enjoy your life.

The reason you think divorce laws favor women is because for the most part they do. Hear me out. It’s not because they have a vagina though its because traditionally women earned less (much less) than men and therefore their bargaining power insofar as relationship dynamics was significantly reduced. It used to be the man could go out and mess with as many women was he pleased but if the woman dared fool around he would put her out in the cold since the golden rule applied. Whoever has the gold makes the rules. Another common scenario was a couple would be married for 20–30+ years far past a woman’s years of general desirability (her reproductive years) and then the man would dump his wife for some 25 year old floozy because ‘he just wasn’t happy anymore’ leaving the woman that stood by him and raised his children with nothing and out in the cold with no marketable job skills to speak of. The laws of divorce were designed to rectify this. As well they should. ‘till death do us part’ isn’t supposed to just be an expression folks. Anyway now the tables are turning and actually more and more women are having to pay up which is why they are leading alimony reform in most states. Anyway to answer your question most divorces are not initiated by men but by women. 70% of divorces are initiated by women in fact. If a man initiates a divorce it’s because his wife did something serious like had an affair or just overall made his life a living a hell. Ironically its usually the woman that wants to get married more than the man but once the wedding ceremony is over its the man that wants to stay in the marriage more than the women. Anecdotally I see way more bitter middle aged divorced men than I do women. Of course neither sex enjoys a divorce but from what I see women tend to feel relieved once its over while a man just can’t seem to get over losing his wife.

your friend got marriage without any ceremony but a marriage cannot be registered without proper documentation you said that all the paper work is arranged by the girl that means from both the sides she manage everything the boy also provide everything to her that's why marriage has been registered without paper formality and documents a marriage cannot be registered with registrar office as per Hindu marriage act and now they don't want to stay together if a marriage has been solomonized and registered with the certificate so they are now husband and wife if they feel they are not made for each other so they can file mutual consent divorce or without mutually it can be possible just to file a divorce in the competent court and she cannot file a case of rape because they are husband wife so I request you just to file case in the competent court thank you
