its been 3 n half years of my marriage. We had a love come arrange marriage. But after 1 month my in-laws started misbehaving with me. They used to do back-bitching with my husband and My husband used to do fight with me, hit me sometimes . He has crossed all the limits man handling, abusing language, mentally, emotionally tourcher. I am done with this relationship. Also i have a baby girl but i want the custody of my daughter.

You have got all the legal rights to file for maintainence u/s 125 cr.p.c. file a petition for cruelty u/s 498 a. and domestic violence. also, you can apply for divorce from him. As far as cusody of child is concerned, courts consider the paramount interest of the child while granting the cusody. and if you are liviing seperate from your husband and taking good care of the child, the status quo is generally maintained.

You can file a divorce petition on the ground of cruelty and can also file a petition for getting the custody of your child. You strictly need to prove cruelty against your husband and his family members.

Yes you can file a divorce petition under domestic violence but firstly you can file a case against your husband and your in laws under domestic violence act and also file a complaint to police station

need not to be worry as per law after filing case you will get the custody of your daughter .rest if your version is true then it will be easy for you to get the custody but on condition that your version is true
