Divorce -mutual divorce from spouse for being rude

Hello i want to get a divorce from my spouce its been 2years of our marriage with one kid boy i have been facing lot of fights between us from the day of our marriage for some or other reason there are mistakes from both the side but the way he treats me in each fight is like hell he hits me and uses all bad unbearable words and after the fight every time he wants me to b normal forget all and repeats the same every time for small things ge gets angry and blames me for everything he doubts on me for all he says if i want to stay at his hime i shuld listen to him and as he wants there are lot of things happened with me but been baring all for the sake of family name but now iam done i cant bare all iam loosing my confidance on myself and becoming weak mentally so what can i do they wont agree for divorce but i dont want to stay with them at any cost

Hello Madam. this is Geeta Advocate. As ur marital living period is very short, might be For the time being u may understand each other in future. if there is no scope to live each other under roof, first u issue a notice for divorce to accept it mutually.

as you are facing mental and physical harrassment you can file a criminal case U/s 498a and also you can file a DVC case as well as maintenance for yourself and for your kid, but it should be discussed detaily in person before you are going to take any such step.

Dear Queriest, the details provided by you indicate that you have been facing physical and mental harassment in the hands of your husband and same is a valid ground for divorce for cruelty. That apart you can also file 498a and DVC.
