Divorce Mutual consent validity. What makes it binding?

Yes you can. Mutual consent means party mutually agreeing to settlement agreement.
If the settlement is not workable for you, no one can force you to sign in the mutual consent divorce. In the case where everything is verbal, you can rethink and if your mind has changed, you can deny for mutual consent and go for contested divorce.

Yes you can make any changes in your draft or statement untill the judge has not given divorce order , you can fight fora legal right you are bound to get which you are not getting in the drafted agreement.

If the divorce agreement has not been signed and is just a verbal discussion it cannot be enforced and does not exist in the eyes of law. Therefore you have a right to contest the divorce suit in case you want to go ahead with the same.

इससे कोई फर्क नहीं पड़ता कि न्यायालय के समक्ष मौखिक रूप से क्या बात हुई.... फर्क इससे पड़ता है कि वाद के पक्षकार क्या चाहते हैं....!
यदि आप तलाक का केस मेरिट पर लड़ना चाहते हैं , तो आप इसके लिए स्वतंत्र हैं ; किन्तु यदि आपसी सहमति के आधार पर आप तलाक लेना चाहते है , तो इसमे दोनों पक्षों का हित है । इसमे आपके समय और पैसों दोनों की ही बचत होगी ।
अंतिम निर्णय आप को ही लेना होगा ।

As per law the petition for divorce by mutual consent is required to be filed jointly with the signature by husband and wife. After filing next date is fixed after 6 month. On that date both are required to appear before the judge and their statement is recorded. At that time of either party does not want divorce by mutual consent he or she can retract before the court and choose to contest. You can contest.
