Divorce matrimonial issue fake documents

12-Feb-2024 (In Divorce Law)
I filed divorce case against wife, So wife filed 498a. While filing 498 case wife modified salary amount on husband salary slip & submitted in police station. So I filed IPC 420 case, But wife edited whatsApp chat & showing as proof. Now she is starting that I sent that salary slip to her. So how can i prove this document is modified by her only? Whether court consider illegal application chat as proof?

Your best course of action is to provide your original salary slip, duly attested by your office or boss, as evidence. Alternatively, allow the investigating officer to file the chargesheet. When the matter reaches court, summon your office head or boss to testify and reveal the true extent of your salary. In a strategic move, you can also retaliate by filing a counter case against your wife under Section 340 Cr.P.C. or pursue charges of perjury against her. This will assertively challenge any false allegations and potentially shift the balance in your favor.

since she has filed the salary proof then it is her liability to prove the authenticity of the slips. you just need to prove that the slips are fabricated. once it is proved by you that the salary slips are fabricated then the onus of proof lies on her whether she has fabricated it or not. also, it is important to note that if it is proved that the slips are fabricated then the focus of court is shifted to why she has filed the fabricated evidence. then it hardly matters whether she has fabricated it or not
