Q: Stilt floor parking for all floors and one hall at the back

My father collaborated with builder for constructing 4 floors and stilt (having parking for all floor owners in front and one hall in back), My father retained GF, stilt back hall, while other floors with parkin were sold by builder. This is clearly mentioned in collaboration agreement with builder, MCD sanctioned map show entire stilt as Parking due to this map other floor owner are claiming the stilt back as common areas (violating the sale deed). Please advice if they can claim the back part

Q: Father WiLL, brother not willing to share

As per my father's WILL, 2 sons are the beneficiaries of the house. But the WILL is with the elder brother. I have asked number of times.about the WILL but he kept putting things off. Now we both don't talk to each other.Can he sell the property to someone without notifying me and not giving my share?Please advise.ThanksRajeev kumar

He may clandestinely sell the property to any person he may know. To avoid all this what we can do is seek a copy from him and then on denial take him to court for will probate and execution thereof. Only thing is you have to be sure about your share.

I live on third floor of a four storey building. Ground floor landlord is creating a back gate in the boundary wall without any permission. Is it legal and can I object it

You can take an injunction order from the court showing your difficulty to the court and also restraining this landlord from constructing anything averse to the sanctioned site plan. Civil proceedings to be initiated.
