we are 3 children- myself (son)& 2 elder sisters. My father gifted his self made property to me through gift deed&also mentioned in his last registered will that he has gifted it.I want to know can children of my sister or their grandchildren stake claim to share of property anytime in future.Original papers of property were carried away by my elder sister deceptively &these papers are still with my sister. Can this property be ancestral property once I gift it to my son.

Advocate Himanshi Jain answered
Since the property has been gifted to you by your father, your sisters have no right in the property therefore their children also lose their right. Please note that the gift deed must be registered. For further queries please contact the undersigned.

Q: Wife asking for mutual divorce and Alimony

My wife gone to her house a month ago with my two kids, first they want divorce without alimony and now she is asking for 50% of my income, I m living in a rented house, my salary is 35000 only. They want me to earn 70000 - 80000 every month any how.She said if I give her money then she will let me meet my kids.I want to stay with my entire family. I tried many times to convince her to stay together. I am losing my health both mentally and physically. She is brainwashed by her parents.

Advocate Himanshi Jain answered
sir, wife cannot claim 50% of your salary in maintenance. while determining the amount of maintenance income of both the parties are calculated, expenses and liabilities are also considered.moreover, the wife cannot force you to earn more, it rather shows that she is greedy. for further queries please contact the undersigned.if the mediation has failed then also you can approach your wife to reconcile the matter and return to you. please note that you can approach the court if you want to bring your back and she is living separately from you without any reasonable ground.
