Divorce case to handle situation

I had been separated from my husband for the last two years. We had jointly purchased the property and are co-owners of the house, for which I had made the 50% payment to him. He is the first owner. He and my in-laws, without informing me, had shifted to that new house, and till now they have not paid any rent or any maintenance for my 5-year-old daughter. They have all of my and my children's belongings, including jewelry, which they are not willing to provide me back.

in this case I suggest you file Maintanence case against husband , and in laws under Dv act or sec 125 of crpc ,
and you can send legal notice your in laws to pay rent for the same

if you are willing to get separated from your husband that is divorced then by sending notice for discussion of mutual consent divorce petition filing you can call your husband for discussion of the same and in the said divorce discussion you can settle down the disputes regarding the house and maintainance of child

Even if you are working and can take care of your daughter, it is the legal responsibility of father to give maintenance to the child. If you want to file for divorce, you can ask for maintenance of your daughter in the said divorce petition. And your 50% share in the property can also be claimed through family court for which you have paid the money. You have many legal options available to you depending on what remedy you want to your matrimonial dispute.

Hello, their are several legal remedies that you can use and handle these situation , As you mentioned that you were separated from your husband since two years , As per legal perspective, your husband have to manage you and your kids financially As well as morally also. but if your husband deny then you can knock courts door. and ask maintainance from your husband for both of you, you can also claim for hour jewelry and belonging from the court with your share in the property. for more details and querry then contact us and visit our website.

Well, you can file a Partition Suit in Court and then once the Partition is done, then, you can sell your parted share of 50 % in such Immovable Property or can evict your In Laws and Husband from such 50 % of parted share of Immovable which you own.
