Divorce after being judicially separated

26-Mar-2025 (In Divorce Law)
Hi, How long can I be judicially separated from my wife. I believe the grounds for separation is same as divorce. If after the completion of separation period, if I choose to divorce then should I again go over the establishing the grounds for divorce as it would have already been done while obtaining separation or is it easier to divorce without much hassles

You can apply for divorce after the separation at any time. Before filing for divorce case better to give notice to your wife. If she will also ready then you file mutual divorce along with dispense application. It will finish within two months. Sometimes in fifteen days also.

Dear Sir, Under Section 10 of Hindu Marriage Act you may seek judicial separation. But, if contested by your wife it will be struck for 2-3 years to get such order. You are advised to stay away from your wife and then file divorce on the ground of cruelty and desertion of two years which will be more stronger for getting legal divorce.
