Delayed in getting notice from Family court ,can we skip the hearing?
14-Feb-2025 (In Divorce Law)
My Husband filled divorce case in court. First hearing was done on 6th feb 2025. But I didn't attend as I got notice on 7th feb 2025. If the 2nd hearing also delayed in getting notice, can I skip the 2nd hearing also?
Since you received the first notice late (on 7th Feb 2025, after the hearing on 6th Feb 2025), you can inform the court about this delay. However, skipping multiple hearings is not advisable because:
1. If you keep missing hearings, the court may proceed ex-parte (without your presence) and decide the case in your husband's favor.
2. If you do not receive the second notice in time, you should formally inform the court or file an application stating that you received the first notice late and that you have not been properly served for the second hearing.
What You Should Do Next:
Check Court Notices Regularly: Keep track of the next hearing date through eCourts or by contacting the court registry.
Attend the Next Hearing or File an Application: If you don’t get a proper notice again, file an application before the court citing improper service of notice and request a new date.
Consider Filing a Response to the Divorce Case: If you wish to contest the divorce, you need to file a written statement (reply) within the timeline.
Would you like help in drafting a response to the divorce case or filing an objection?
