Dear Sir/Madam, I need your legal advice regarding my marriage. My husband is involved in adultery, and this is the reason I am not staying at my in-laws’ house. Because of this, he is now thinking of giving me a divorce. I would like to know if I disclose his adultery in court, will it affect his ability to get a divorce easily? Also, can I refuse divorce on this ground, or will the court still grant it? Please guide me on my legal rights and what options I have in this situation. Thank you.

If your husband is committing adultery, you have the right to file for divorce on this ground. Disclosing his adultery in court will make it harder for him to get a divorce against you on other Grounds. You can refuse consent for divorce, The Court will not Grant divorce easily if you contest and prove his adultery. You also have the right to claim maintenance and custody of your children if any. Immediately consult a lawyer to protect your interests.

Thank you for reaching out. If your husband is involved in adultery, it is a valid ground for you to seek divorce under Indian law. However, if he is filing for divorce, he must establish a legally recognized ground. If you oppose the divorce and he fails to prove his grounds (such as cruelty or desertion), the court may not easily grant it. Disclosing his adultery can strengthen your position and may impact the court's decision. You also have rights to seek maintenance, residence, and custody (if applicable). I recommend a detailed legal consultation to explore your options and build your case properly.
